This Information and Clarification Form has been prepared within the scope of the processing and transfer of the “Personal Data” of real persons regulated by the Personal Data Protection Law No. 6698 (“PDPL”). Within the scope of Law No. 6698, all up-to-date information belonging to you that you have shared with our company shall be considered as “Personal Data”. The security of your personal data is of great importance to us, and your personal data will be stored in accordance with the conditions stipulated by the legislation, in the most secure manner possible and for the period required by legal obligations, under conditions compliant with the legislation.

  1. a) Data Controller and Its Representative

Pursuant to the Personal Data Protection Law No. 6698 (“PDPL”), your personal data may be processed by AHK İMAR PLANLAMA HARİTA MÜH. VE GAYRİMENKUL İNŞ. SAN. TİC. A.Ş. (briefly AHK Inc.) as the “Data Controller” within the scope explained below.

  1. b) For What Purposes Your Personal Data May Be Processed

Your collected personal data may be processed within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of Law No. 6698 for the purposes of fulfilling the obligations of our company and real and legal persons with whom our company has business relations; providing information regarding updates; establishing and performing contracts to be concluded with you; reminding and fulfilling legal obligations; carrying out various advertising and marketing activities; conducting and following up finance, accounting, and legal affairs; monitoring and resolving your requests and complaints – monitoring contract processes and/or legal claims; planning and executing customer satisfaction activities, receiving your opinions through surveys and polls; determining products, projects, and services suitable for you, customizing and improving them; providing effective customer services; notifying you of changes in legislation or internal company policies that concern you or making other notifications related to you; celebrating birthdays; including you in lotteries or competitions; giving gifts and carrying out other similar events, promotions, and campaigns in your favor; informing you via e-mail, SMS, and fax; informing you about campaigns; sending you printed bulletins, magazines, and campaign-related materials; determining visitor profiles; evaluating requests, demands, and complaints; conducting our company’s human resources policies; and responding to your requests and questions.

  1. c) To Whom and For What Purpose the Processed Personal Data May Be Transferred

Your collected personal data is processed in accordance with the principles of compliance with the law and good faith, accuracy and being up to date when necessary, being processed for specific, explicit, and legitimate purposes, being relevant, limited, and proportionate to the purpose for which they are processed, and being retained for the period stipulated in the relevant legislation or required for the purpose for which they are processed. In addition, provided that the conditions stipulated in Articles 8 and 9 of the PDPL are complied with and necessary security measures are taken, your personal data may be shared, limited to the purposes listed under section (b) of this notice, with our domestic/foreign direct or indirect affiliates or subsidiaries; domestic/foreign/international public/private institutions and organizations, companies, and other third parties or organizations from which our company receives services/support/consultancy, cooperates with, or partners in projects/programs/financing; our company’s affiliated companies, subsidiaries, consultants, shareholders, or solution partners and other group companies; the Central Securities Depository and other authorized institutions and organizations; suppliers or subcontractors, within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of Law No. 6698. AHK Inc. may process and store your personal data, provided that necessary security measures are taken, within Turkey or abroad, on servers or other electronic environments, provided that there is adequate protection in the foreign country to which the personal data will be transferred; if there is no adequate protection in the relevant foreign country, provided that AHK Inc. and the data controllers in the relevant foreign country undertake in writing to provide adequate protection and the approval of the Board is obtained.

ç) Method and Legal Reason for Collecting Your Personal Data

Your personal data may be obtained by our Company through different channels (such as the headquarters, branches, agencies, sales offices of AHK Inc. or other subcontractors or business partners; offices and other physical environments where you may contact them; call centers; websites; mobile applications and similar electronic transaction platforms; social media or other public channels; participation in trainings, conferences, and similar events they organize; investigation methods; or through other group companies or other contracted persons and organizations) in written, verbal, audio, or visual form or through other physical or electronic media, etc. Your personal data may be collected, processed, transferred, and stored for the purposes specified in sections (b) and (c) of this text within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the PDPL. Your personal data is stored under conditions compliant with the legislation for the period required by legal obligations or for the period permitted by the relevant legislation.

  1. d) Your Rights as a Personal Data Owner

As personal data owners, if you submit your requests regarding your rights to our Company through the methods regulated below, our Company will finalize your request free of charge as soon as possible and at the latest within thirty days, depending on the nature of the request. However, if a fee is stipulated by the Personal Data Protection Board, the fee in the tariff determined by our Company will be charged. In this context, personal data owners have the right to:

  • Learn whether personal data is processed,
  • Request information if personal data has been processed,
  • Learn the purpose of processing personal data and whether they are used in accordance with their purpose,
  • Know the third parties to whom personal data is transferred domestically or abroad,
  • Request correction of personal data if it is processed incompletely or incorrectly and request notification of the transaction made within this scope to third parties to whom the personal data has been transferred,
  • Request deletion or destruction of personal data if the reasons requiring processing are eliminated, even though it has been processed in accordance with the PDPL and other relevant legal provisions, and request notification of the transaction made within this scope to third parties to whom the personal data has been transferred,
  • Object to the emergence of a result against the person by analyzing the processed data exclusively through automated systems,
  • Request compensation for damages in case of loss due to unlawful processing of personal data.

Pursuant to Article 13/1 of the PDPL, you may submit your request regarding the exercise of your rights mentioned above to our Company in writing. You may submit your request, including your explanations regarding the right you request to exercise among the rights specified in Article 11 of the PDPL, by filling out the form at www.ahkgayrimenkul.com and delivering a wet-signed copy of the form in person with documents identifying your identity to the AHK Inc. Customer Relations Department at the address “Ahlatlıbel Mah. 1902. Sokak No:64/1 06805 Çankaya/Ankara” or sending it via a notary public.

Our Company reserves the right to make changes to this information notice due to possible amendments to the PDPL and methods to be determined by the Personal Data Protection Board.
